Definitions

'HOST-PHOTO.com' refers to this website, and excludes its shareholders, owners, or operators.
'Photo' refers to any image that has the potential to be uploaded to HOST-PHOTO.com.
'User' refers to the individual who uploads photos to HOST-PHOTO.com, has uploaded files to HOST-PHOTO.com, or accesses files from HOST-PHOTO.com.
'URL' refers to the location of any photo located on HOST-PHOTO.com servers.

Terms of Service

HOST-PHOTO.com reserves the right to remove or replace any uploaded photos, and assumes no liability for lost registration links or misplaced photo URLs. Changing HOST-PHOTO.com linking codes is prohibited without prior permission.

The following types of photos constitute "abuse" may not be uploaded under any circumstances:

• Pornographic photos. This includes, but is not limited to, photos depicting genitalia, nudity, or sexual situations.
• Photos that are illegal and/or are in violation of any laws.
• Photos that infringe on the copyrights of any entity excluding the user.
• Non-image files. This includes archived non-image files.
• Photos intending to harass or spam, or promote anything for commercial profit.

Uploading abusive photos may result in the immediate termination of the user's ability to use HOST-PHOTO.com or any of its provided services. The HOST-PHOTO.com website may not load, all HOST-PHOTO.com-hosted files may not load, and all files related to the abusive photos will be subject to deletion. Circumventing HOST-PHOTO.com's ability to enforce the HOST-PHOTO.com Terms Of Service will result in prosecution.

Privacy

All information provided by the user is strictly confidential. HOST-PHOTO.com will never release any personal information about the user without permission. However, HOST-PHOTO.com reserves the right to release user information if user has violated the HOST-PHOTO.com Terms Of Service, if the user has committed unlawful acts, if the information is subpoenaed, or if HOST-PHOTO.com deems it necessary or appropriate.

HOST-PHOTO.com is not responsible for the content of any uploaded photos, nor is it in affiliation with any entities that may be represented in the uploaded photos.

Except where diligently implied, absolutely no part of HOST-PHOTO.com may be reproduced or recreated without explicit written permission by operators of HOST-PHOTO.com.

Limitation of Liability

Indemnity

User agrees to indemnify and hold HOST-PHOTO.com harmless from any loss, liability, claims, damages and expenses, including attorneys fees, arising from or related to the content, use, or deletion of user's photos or use of any other feature or service. This expressly includes:

• User's responsibility for any and all liability arising from the violation or infringement of proprietary rights or copyrights.
• Any defamatory or unlawful material contained within User's Files.

Maintenance

HOST-PHOTO.com may perform maintenance services as HOST-PHOTO.com determines reasonably necessary. User acknowledges that such maintenance may require downtime. HOST-PHOTO.com will attempt to provide prior notice of the maintenance downtime, except in the case that circumstances beyond HOST-PHOTO.com's control limit the ability to do so.
